TakeMe Terms of Service
1. Acceptance of Terms
These Terms of Service (“Terms”) govern the use of the services provided by TakeMe (“TakeMe”, “we”, “us”, or “our”), including restaurant reservation services, concierge-assisted booking services, prepaid dining packages, voucher services, and related platform services (collectively, the “Services”).
By accessing or using the Services, users (“Users”) agree to be bound by these Terms. If a User does not agree to these Terms, the User must not use the Services.
2. Description of Services
TakeMe operates a digital platform that assists Users in securing dining reservations and related services at restaurants in Japan.
The Services may include:
Real-time restaurant reservations
Reservation requests submitted to restaurants
Concierge-assisted reservation services
Prepaid dining packages
Promotional vouchers and coupon services
Other related services provided through the platform
TakeMe acts as a reservation facilitation and concierge service platform and provides technological and operational support to assist Users with restaurant reservations and related services.
Restaurant services themselves are provided by the restaurants.
3. Reservation Requests and Confirmation
Users may submit reservation requests through the platform by providing the required information.
Submitting a reservation request does not guarantee that a reservation will be confirmed.
A reservation is considered confirmed only when confirmation is issued by TakeMe or the restaurant.
Upon confirmation of a reservation, a reservation relationship is formed between the User and the restaurant.
4. Reservation Availability
TakeMe will make reasonable efforts to facilitate reservations but does not guarantee reservation availability.
However, TakeMe does not guarantee that reservation requests will always be successful.
Reservations may fail due to restaurant availability, operational constraints, or technical limitations.
In the event that a reservation cannot be successfully completed due to platform or operational issues, any applicable fees paid by the user will be refunded.
5. Platform Role
TakeMe provides reservation facilitation, concierge assistance, and related platform services.
Restaurants are independent third-party service providers. The dining services, food quality, pricing, and restaurant operations are solely managed by the restaurants.
TakeMe does not operate the restaurants and does not control restaurant operations.
6. Restaurant Responsibility
Restaurants listed on the platform are independent third-party service providers.
TakeMe does not control or operate the restaurants and is not responsible for the quality of food, service standards, pricing, or restaurant operations.
Any disputes related to restaurant services should be resolved directly between the user and the restaurant.
7. Restaurant Information
Information regarding restaurants available on the platform may be obtained from:
restaurant partners
publicly available information
third-party data sources
information submitted by restaurants
While TakeMe makes reasonable efforts to maintain accurate information, TakeMe does not guarantee that restaurant information is complete, current, or accurate.
Users are responsible for confirming important details directly with the restaurant where necessary.
Translations of restaurant information may be provided for convenience only, and TakeMe does not guarantee the accuracy of such translations.
8. Fees and Payments
Certain Services may require payment.
Fees may include:
reservation service fees
concierge service fees
VIP service fees
prepaid dining package payments
other applicable service charges
The total amount payable will be displayed during the booking process.
Payments may be processed through TakeMe’s designated payment systems.
9. Reservation Fees and Completion of Service
For reservation-based services, TakeMe’s service is considered completed once a reservation is successfully confirmed.
Once a reservation is confirmed, the associated reservation service fees are non-refundable.
10. Prepaid Dining Packages
Certain restaurants may offer prepaid dining packages through the platform.
For prepaid dining packages:
restaurant-specific cancellation policies may apply
refunds may be available according to the applicable cancellation terms
refund eligibility will be clearly indicated during the purchase process
11. Voucher Services
TakeMe may offer promotional vouchers or coupon-based services.
For vouchers:
vouchers provide promotional benefits for restaurant use
vouchers may be cancelled and refunded before redemption
once a voucher has been redeemed or used at a restaurant, it becomes non-refundable
12. Cancellations and Changes
Cancellation and modification policies may vary depending on the service type and restaurant policies.
Reservation-based services may be subject to restaurant-specific cancellation policies.
Detailed rules regarding cancellations and refunds are described in the Cancellation Policy, which forms part of these Terms.
13. User Responsibilities and Prohibited Conduct
Users must not engage in activities that disrupt or misuse the Services.
Prohibited conduct includes but is not limited to:
making reservations without genuine intent to dine
failing to appear at confirmed reservations without notice (no-show)
submitting false or misleading information
making excessive or overlapping reservations in bad faith
interfering with the operation of the platform
attempting unauthorized access to the system
TakeMe may suspend or restrict access to Users who engage in prohibited conduct.
14. Abuse of Reservation System
Users must not misuse the reservation system, including but not limited to:
- making reservations without the genuine intention to dine
- repeated no-shows
- submitting false reservation information
- intentionally blocking restaurant availability
TakeMe reserves the right to suspend or restrict accounts that engage in abusive reservation behavior.
15. Third-Party Services
The Services may involve third-party service providers, including but not limited to:
payment service providers
communication service providers
technical service providers
restaurant partners
TakeMe is not responsible for services provided by third parties.
16. Service Availability
TakeMe may modify, suspend, or discontinue any part of the Services at any time for operational, technical, or business reasons.
Temporary interruptions may occur due to system maintenance, technical issues, or other circumstances beyond our control.
17. Intellectual Property
All intellectual property rights related to the platform, including software, design, text, graphics, and trademarks, belong to TakeMe or its licensors.
Users may not reproduce, modify, distribute, or otherwise exploit any content from the platform without prior authorization.
18. Privacy
Personal information provided by Users will be handled in accordance with the TakeMe Privacy Policy.
User information necessary to process reservations or services may be shared with restaurants or relevant service providers as required for service delivery.
19. Disclaimer
The Services are provided on an “as-is” and “as-available” basis.
TakeMe does not guarantee:
successful reservation outcomes
restaurant availability
accuracy or completeness of restaurant information
uninterrupted or error-free operation of the Services
20. Limitation of Liability
To the maximum extent permitted by law, TakeMe shall not be liable for indirect, incidental, special, or consequential damages arising from the use of the Services.
TakeMe’s total liability in connection with the Services shall not exceed the amount of fees actually paid by the User to TakeMe for the relevant reservation or service.
21. Termination
TakeMe may suspend or terminate a User’s access to the Services if the User violates these Terms or engages in conduct that TakeMe determines to be inappropriate or harmful to the platform.
22. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted in accordance with the laws of Japan.
Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court.
These Terms apply to all services provided through the TakeMe platform, including reservation services, prepaid dining packages, voucher services, and concierge booking services.
